The paper refers to the problems related to the qualification of premeditated murder envisaged
by Article 109 Paragraph I (b) of the Criminal Code. It discusses the case of murder when a murder
tool is an object or instrument that is dangerous for not only the person who is attacked to be murdered
but also for persons around him/her. These are individuals who are not related to the murder.
It should also be taken into consideration that it is not necessary that the murdered person or other
persons (whose life and health is endangered) be at the same place.
